The district solicitor hasn't commented. Law enforcement had not contacted Mr. Trump's lawyer, Susan Necheles.
The probe was called "an appalling abuse of power by a radical DA" by House Republican Leader Kevin McCarthy.
He tweeted that he would investigate government money being used to intervene in elections "with politically motivated prosecutions".
Any indictment would force Mr. Trump's Republican Party opponents to decide whether to attack the former president while he is distracted or wait and hope.
